{"id":4859,"date":"2026-08-20T22:19:39","date_gmt":"2026-08-20T20:19:39","guid":{"rendered":"https:\/\/mts.addlab.net\/odv\/"},"modified":"2026-09-25T11:30:19","modified_gmt":"2026-09-25T09:30:19","slug":"odv","status":"publish","type":"page","link":"https:\/\/mts.addlab.net\/en\/odv\/","title":{"rendered":"ODV"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>231 and Whistleblowing<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Following the entry into force of Legislative Decree No. 231 of June 8, 2001, which introduced into the Italian legal system a regime of administrative liability for companies, MTS srl&#8217;s Governance system has been enhanced with the implementation of the Organization, Management, and Control Model in accordance with the provisions of this legislation. Furthermore, a Supervisory Body (Organismo di Vigilanza &#8211; ODV) has been established, tasked with overseeing the operation and observance of the aforementioned Model and ensuring its updates.  <\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The \u201cModel pursuant to Legislative Decree 231\/01\u201d approved by the Board of Directors is updated to the latest regulatory provisions.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The Governance System is also completed with the adoption of the <a href=\"\/wp-content\/uploads\/2026\/08\/codice-etico.pdf\">Code of Ethics<\/a>.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<h3 class=\"wp-block-heading\">Reporting Channel<\/h3>\n\n<p class=\"wp-block-paragraph\">As an employee, supplier, or client of MTS srl, you can report illicit activities anonymously or state that you have reasonable suspicion of them.<\/p>\n\n<p class=\"wp-block-paragraph\">You can submit your report via the email address odv@milanotattoschool.it or this voicemail box 0297134146.<\/p>\n\n<p class=\"wp-block-paragraph\">Reports can be submitted confidentially by providing your name and contact details, or, if you prefer, completely anonymously. You will receive a response regarding the processing and updates on the progress of the report via the contact email or, if using the voicemail box, if you leave a contact number, even if not nominative. <\/p>\n\n<p class=\"wp-block-paragraph\">The email and voicemail message are received exclusively by the President of the Supervisory Body, who is a guarantor figure free from conflicts of interest regarding the report and competent in governance matters. The President of the ODV is responsible for initiating the internal investigation and has an allocation for the involvement of any experts and consultants. <\/p>\n\n<p class=\"wp-block-paragraph\">You and any reported individuals are guaranteed rights and protections, some of which are illustrated in the following information notice.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<h3 class=\"wp-block-heading\">Privacy Policy<\/h3>\n\n<p class=\"wp-block-paragraph\">This information notice is provided by MTS srl regarding the processing of personal data carried out by it through the channels for reporting violations or irregularities, i.e., Whistleblowing, and concerns both \u201cthe whistleblower\u201d and \u201cthe reported party.\u201d If the report comes from an individual with an employment or collaboration relationship with the Company, this information notice should be understood as supplementary and not a replacement for the information provided to personnel for managing the employment relationship. <\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Purpose and Legal Basis of Processing<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The personal information concerning you as a whistleblower will be processed to ensure:<\/p>\n\n<p class=\"wp-block-paragraph\">1) the correct and complete management of the Whistleblowing procedure in accordance with current<\/p>\n\n<p class=\"wp-block-paragraph\">whistleblowing legislation;<\/p>\n\n<p class=\"wp-block-paragraph\">2) the necessary preliminary activities aimed at verifying the validity of the reported fact and the adoption of consequent measures;<\/p>\n\n<p class=\"wp-block-paragraph\">3) the judicial protection of a right of the Data Controller;<\/p>\n\n<p class=\"wp-block-paragraph\">4) the response to a request from the Judicial Authority or an equivalent Authority.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing is the fulfillment of legal obligations: management of the Whistleblowing procedure, as provided by Law No. 179 of November 30, 2017, concerning \u201cProvisions for the protection of individuals who report crimes or irregularities they become aware of in the context of a public or private employment relationship.\u201d <\/p>\n\n<p class=\"wp-block-paragraph\">Regarding \u201cthe reported party\/parties,\u201d the purpose is the use of their personal data collected following the submission of reports against them concerning behaviors, acts, or omissions that harm the public interest or the integrity of the public administration or private entity, pursuant to Article 2, paragraph 1, letter a), of Legislative Decree No. 24\/2023, for investigations and inquiries related to the reported conduct.   <\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing is to fulfill a legal obligation (pursuant to Legislative Decree No. 24\/2023).<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Type of Data Processed and Collection Methods<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The Controller collects and\/or receives the information you provide by entering it through the following channels:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>email to the President of the ODV (Supervisory Body)<\/li>\n\n\n\n<li>voicemail box of the President of the ODV<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The collected information includes:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>any personal and identifying data of the whistleblower (name, surname, role);<\/li>\n\n\n\n<li>personal data of the reported party\/parties (name, surname).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The provision of whistleblower data is optional; it is possible to choose between confidential and anonymous modes.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Access and Data Sharing<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The communication of collected personal data primarily occurs with third parties and\/or recipients whose activity is necessary for carrying out activities related to report management, as well as for complying with certain legal obligations.<\/p>\n\n<p class=\"wp-block-paragraph\">Specifically, transmission may occur to:<\/p>\n\n<p class=\"wp-block-paragraph\">a) the Whistleblowing officer identified by the Controller \u2013 President of the ODV;<\/p>\n\n<p class=\"wp-block-paragraph\">b) external consultants (e.g., law firms) potentially involved in the preliminary investigation phase of the<\/p>\n\n<p class=\"wp-block-paragraph\">report;<\/p>\n\n<p class=\"wp-block-paragraph\">c) any corporate functions involved in the activity of receiving, examining, and evaluating reports;<\/p>\n\n<p class=\"wp-block-paragraph\">d) institutions and\/or Public Authorities, Judicial Authority, Police Bodies, investigative agencies;<\/p>\n\n<p class=\"wp-block-paragraph\">Personal data will not be disseminated or disclosed in any way to parties other than those identified above.<\/p>\n\n<p class=\"wp-block-paragraph\">The Controller does not transfer personal data to third countries.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Retention Period and Security Measures<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Data processing is carried out using simple digital means and tools provided by Siteground providers.<\/p>\n\n<p class=\"wp-block-paragraph\">The Controller, also through authorized data processors, periodically verifies that:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the technical and organizational security measures related to the tools through which data are processed are effective, in good condition, and constantly updated;<\/li>\n\n\n\n<li>data are not collected, processed, stored, or retained beyond what is necessary;<\/li>\n\n\n\n<li>data are stored with adequate guarantees of integrity and authenticity and for their use for the purposes of the processing actually carried out;<\/li>\n\n\n\n<li>data are stored for the time necessary to complete the activities related to the management of the report you submitted and, in particular, not beyond the pre-established time.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In particular, collected personal data are stored for a period not exceeding five years, starting from the date of receipt of the Report, as well as for the entire period necessary for the conduct of any proceedings arising from the management of the report (disciplinary, criminal, accounting).<\/p>\n\n<p class=\"wp-block-paragraph\">Retention for a longer period is reserved in relation to requests from public authorities and the Data Protection Authority.<\/p>\n\n<p class=\"wp-block-paragraph\">The retention of personal data, including special categories of data, for a longer period is reserved, within the limits of the statute of limitations for rights, in relation to needs connected to the exercise of the right of defense in case of disputes.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Data Subjects&#8217; Rights<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Compatible with the purposes and limits established for the processing of personal data of the whistleblower and the reported party, the recognized rights are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>access;<\/li>\n\n\n\n<li>rectification;<\/li>\n\n\n\n<li>erasure;<\/li>\n\n\n\n<li>restriction of processing;<\/li>\n\n\n\n<li>objection to processing;<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Pursuant to Article 2-undecies of the Privacy Code (implementing Article 23 of the GDPR), it is hereby informed that the aforementioned rights cannot be exercised by the reported data subjects (by request to the Controller or by complaint pursuant to Article 77 of the GDPR) if the exercise of such rights could cause actual and concrete prejudice to the confidentiality of the whistleblower&#8217;s identity. If you believe that the processing of personal data carried out by the Controller violates the provisions of Regulation (EU) 2016\/679, the data subject has the right to lodge a complaint with the supervisory authority, in particular in the Member State of their habitual residence or place of work, or the place where the alleged violation of the regulation occurred (Garante Privacy
